Acceptance of Terms.
By accessing or using ENGAI, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
User Responsibilities.
ENGAI is a digital platform that enables users to discover opportunities, prepare proposals, and connect with other parties. The platform facilitates pre-award activities only and does not participate in project execution, supervision, or delivery.
No Contractual Responsibility.
ENGAI is not a party to any agreement, contract, or transaction between users. All engagements, negotiations, and contracts are solely between the involved parties.
User Obligations.
Users must provide accurate, lawful, and up-to-date information. Users are responsible for all activities conducted through their accounts and must not misuse the platform.
Use of AI and Generated Content.
ENGAI provides AI-generated outputs designed to support the preparation of high-quality, professional proposals and decision-making processes. While ENGAI strives to deliver accurate and reliable content, all outputs are subject to user review and validation. The user remains solely responsible for verifying, approving, and using the final content, and ENGAI does not assume responsibility for decisions or outcomes based on such outputs.
Content Ownership and Rights.
Users retain ownership of their data and uploaded content. By using the platform, users grant ENGAI a limited license to process and use such content solely for platform functionality and service delivery.
Confidentiality and Data Use.
ENGAI is strictly committed to maintaining the confidentiality and protection of user data and information. The platform implements appropriate technical and organizational measures to safeguard all data against unauthorized access, disclosure, or misuse. ENGAI will not share or disclose user information to any third party except as required for platform functionality or by applicable laws. Users are responsible for managing and controlling the sensitivity of the information they upload or share on the platform and for ensuring that such content is appropriate for use within a digital environment.
Platform Access and Services Availability.
ENGAI reserves the right to update, modify, or temporarily suspend the platform or any of its features for maintenance, upgrades, or operational improvements. Where reasonably possible, users will be provided with prior notice of any planned service interruption, including the expected duration. In the event that a scheduled interruption exceeds the notified duration in a material manner, ENGAI may, at its discretion, provide affected users with a reasonable service extension or equivalent compensation, particularly for active paid subscriptions. In exceptional circumstances, including but not limited to security risks, system failures, or events beyond reasonable control (force majeure), the platform may be suspended without prior notice. ENGAI shall not be held liable for any such interruptions, provided reasonable efforts are made to restore the service promptly.
Limitation of Liability.
To the maximum extent permitted by applicable law, ENGAI shall not be liable for any direct, indirect, incidental, or consequential damages arising from or related to the use of the platform, including decisions made based on platform outputs. ENGAI shall not be responsible for any damages resulting from user misuse of the platform, reliance on inaccurate or incomplete information, or failure to properly review and validate generated content. The user remains solely responsible for all actions, decisions, and outcomes derived from the use of the platform.
Account Suspension and Termination.
ENGAI reserves the right to suspend or terminate user accounts in cases of misuse, violation of these terms, or any activity that may harm the platform or other users.
Amendments.
ENGAI may revise these Terms at any time. Continued use of the platform after updates constitutes acceptance of the revised Terms.
